1. Introduction

These Terms of Service govern your use of Cypher, an electronic private prescription platform operated by Cypher Health Ltd. By creating an account or using our services, you agree to be bound by these terms.

2. Eligibility

Prescriber accounts are available to healthcare professionals registered with the GMC, GPhC, NMC, or other recognised UK regulatory bodies. Pharmacy accounts require valid GPhC registration. All users must be at least 18 years old and based in the United Kingdom.

3. Prescriber Obligations

  • You must maintain valid professional registration and indemnity insurance at all times
  • Prescriptions must comply with GPhC Regulation 217 and the Human Medicines Regulations 2012
  • Controlled drug prescriptions must adhere to the Misuse of Drugs Regulations 2001
  • You are solely responsible for clinical decisions and the appropriateness of prescriptions issued
  • You must not share your account credentials with any other person

4. Pharmacy Obligations

  • Pharmacies must verify patient identity before dispensing
  • All dispensing must comply with GPhC standards and applicable regulations
  • Controlled drug dispensing must follow Schedule-specific requirements

5. Fees and Payment

Prescribers are charged £1.00 + VAT per prescription issued. Payment is collected via Direct Debit through GoCardless at the end of each monthly billing period. Invoices are generated automatically and available in your dashboard.

6. Data Protection

We process personal data in accordance with UK GDPR and the Data Protection Act 2018. Patient data is encrypted at rest using AES-256-GCM. For full details, see our Privacy Policy.

7. Account Suspension

We reserve the right to suspend or terminate accounts that violate these terms, are involved in fraudulent activity, or where professional registration has lapsed. We will provide notice where reasonably possible.

8. Limitation of Liability

Cypher provides a platform for electronic prescription management. We are not responsible for clinical decisions, prescribing errors, or dispensing outcomes. Our liability is limited to the fees paid for the service in the preceding 12 months.

9. Changes to Terms

We may update these terms from time to time. Material changes will be notified via email at least 30 days before taking effect. Continued use after changes constitutes acceptance.

10. Governing Law

These terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
